StudioRadio Network | WAGC 104.7 FM confirm the immediate deployment of updated Terms and Conditions of Services. This update ensures regulatory compliance and operational clarity for all stakeholders, including advertisers, independent artists, and studio partners.

1. ACCEPTANCE OF TERMS

Engagement with WAGC 104.7 FM services constitutes formal agreement to these protocols.

  • Usage of digital streaming platforms, FM broadcast slots, and studio facilities is governed by this document.

  • AGREEMENT is established upon submission of audio material, execution of advertising contracts, or booking of studio residency.

  • Accessing wagc.fm or affiliated network nodes signals acknowledgment of these legal boundaries.

> "Usage of services (submissions, studio time, advertising) constitutes a binding agreement between the Client and StudioRadio Network."

2. SERVICES & NO GUARANTEES

WAGC 104.7 FM provides high-fidelity FM broadcasting and digital reach to the DC metro area.

  • BROADCASTING and promotion opportunities are facilitated through professional submission channels.

  • Specific commercial results, including lead generation or sales metrics, are NOT GUARANTEED.

  • Airplay rotation is subject to programming director approval and scheduling availability.

  • Standard artist submissions do not guarantee specific time slots unless formalized in a PREMIUM AIRPLAY AGREEMENT.

3. CONTENT STANDARDS

All audio and visual material must adhere to strict FCC COMPLIANCE and station quality benchmarks.

  • SUBMISSIONS must be "clean" and free of profane, indecent, or obscene content as defined by 47 CFR § 73.3999.

  • Audio must meet professional broadcast engineering standards: 44.1kHz/16-bit minimum resolution.

  • WAGC 104.7 FM reserves the right to reject material that fails technical or community standards.

  • STATION IDENTIFICATION announcements must remain unobstructed during integrated programming segments.

4. OWNERSHIP & LICENSING

Clients maintain primary ownership of original intellectual property while granting operational rights to the station.

  • A NON-EXCLUSIVE LICENSE is granted to WAGC 104.7 FM for the duration of the campaign or residency.

  • Rights include the ability to BROADCAST, STREAM, and PROMOTE the material across all network assets.

  • This license extends to archival usage on the WAGC news portal and social media integrations.

  • Metadata and artist likeness may be used for promotional attribution during live broadcasts.

5. INDEMNIFICATION

Partners and clients assume full legal responsibility for the content they provide to the network.

  • CLIENTS hold the Station and StudioRadio Network harmless from all legal claims.

  • This includes, but is not limited to, claims of defamation, copyright infringement, or trademark violations.

  • Indemnification covers legal fees and damages arising from third-party actions related to client content.

  • PARTNERS are responsible for securing all necessary mechanical and performance rights for submitted audio.

6. DMCA / COPYRIGHT TAKEDOWN

WAGC 104.7 FM enforces a rigorous Digital Millennium Copyright Act (DMCA) protocol.

  • Copyright holders may report alleged infringement through the official WAGC resources page.

  • Reports must include a digital signature, identification of the copyrighted work, and contact information.

  • Infringing material will be removed from streaming caches and FM rotation lists within 72 business hours of verification.

  • REPEAT INFRINGERS will face permanent termination of service access.

7. PAYMENTS & REFUNDS

Financial transactions are processed through StudioRadio Network business infrastructure.

  • All fees for advertising, airplay packages, and studio time are NON-REFUNDABLE once services commence.

  • "Commencement" is defined as the point of technical setup, slot reservation, or initial production work.

  • Invoices must be settled according to the timeline specified in the Business Registrations Phase.

  • LATE PAYMENTS may result in the suspension of broadcast schedules and digital streaming links.

8. LIMITATION OF LIABILITY

Operational risks are managed to minimize disruption, but technical absolute-reliability is not warranted.

  • WAGC 104.7 FM is not liable for INDIRECT DAMAGES or lost profits resulting from technical interruptions.

  • Atmospheric interference, equipment failure, or power outages do not constitute a breach of contract.

  • Liability for any service failure is limited to the pro-rated value of the affected broadcast segment.

  • Digital streaming uptime is subject to third-party network provider stability.

9. GOVERNING LAW

All legal disputes are adjudicated under the jurisdiction of the State of Maryland.

  • Legally binding venue: PRINCE GEORGE’S COUNTY.

  • Disputes shall be resolved in accordance with Maryland state statutes and local regulations.

  • Any provision found unenforceable by a court of competent jurisdiction will be severed without affecting the remainder of the terms.

10. UPDATES

Terms are subject to periodic revision to reflect evolving regulatory and technological landscapes.

  • AMENDMENTS are effective immediately upon posting to the Terms page.

  • It is the responsibility of the client to review these protocols regularly.

  • Continued usage of station services post-update signifies RE-ACCEPTANCE of the revised terms.
